Terms of Service
Last updated: October 13, 2026
These Terms of Service ("Terms") govern your use of HI.1s.again at hi1sagain.com (the "Platform"), operated by Heuristic Technologies & Solutions, Inc., a Delaware corporation ("we," "us," "our"). By using the Platform, including ordering at a restaurant without an account, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Platform.
Restaurants and other businesses: your use of the business tools (menu, ordering, kitchen dashboard, loyalty, POS integrations and related services) is also governed by our Restaurant Terms. If the two conflict, the Restaurant Terms apply to your business use.

1. Eligibility and accounts
- You must be at least 16 years old to create an account. Anyone may order at a restaurant table as a guest, but a person under 16 should do so with a parent or guardian.
- You can sign in with Google or other methods we offer. Give accurate information and keep your sign-in secure; you're responsible for activity on your account.
- One account per person. Accounts may not be shared, sold or transferred.
2. The Platform
HI.1s.again lets you:
- At restaurants: open a restaurant's digital menu from a table tag or QR code, order from your table (alone or with others at your table), track your order, view your bill, earn and use rewards, and leave feedback.
- Across restaurants: keep one profile that tracks your visits and rewards at each restaurant that uses HI.1s.again, under a display name or alias you choose.
- In the product community: discover products, answer polls, add products, scan barcodes and share opinions.
Diner and community features are free. Some features may be in testing, and we may add, change or remove features over time.
3. Ordering at restaurants
- The restaurant is the seller. Each restaurant decides its menu, prices, availability and taxes, prepares and serves your food, takes your payment, and is responsible for its products and service. HI.1s.again provides the ordering technology; we are not a party to your purchase.
- Placing an order sends a request to the restaurant. The restaurant may confirm, change or cancel it (for example if an item is unavailable).
- Prices and totals shown on your phone, including tax and discounts, are estimates. The restaurant's receipt from its point-of-sale system is the final amount.
- Payment happens with the restaurant, on its own point-of-sale system (for example a Clover device). HI.1s.again does not process payments or receive your card details.
- Allergies and dietary needs: menu descriptions come from the restaurant. Always confirm allergens and ingredients with restaurant staff before ordering.
- Shared tables: anyone who joins your table with its code can add items and place orders for the table. Share your table code only with people at your table. You're responsible for items you add.
- Problems with an order, refunds and disputes are handled by the restaurant. We're happy to help pass a message on at support@hi1sagain.com.
4. Rewards, visits and memberships
- Set by each restaurant. Visit milestones, rewards, offers and memberships are created and funded by the restaurant offering them, which sets their rules, such as what counts as a visit, minimum order amounts, eligible items, discount caps, days and times they apply, and expiry dates.
- Where they apply. Rewards are earned and used only at the restaurant that offers them, and only through HI.1s.again.
- No cash value. Rewards, points and badges have no cash value and can't be sold, transferred or exchanged for cash.
- Used and returned rewards. A reward is marked used when it's applied to a placed order. If that order is cancelled, the reward is returned to you if it hasn't expired.
- Changes. A restaurant may change or end its program; rewards you've already unlocked are honored until they expire unless the law says otherwise. We may correct rewards given in error and remove rewards obtained through fraud or misuse.
- Memberships sold by a restaurant are governed by the price and terms shown when you join. Questions about membership charges or refunds go to the restaurant.
5. Feedback and reviews
- Feedback you give about a visit (ratings, survey answers, comments) is shared with that restaurant and may be shown in aggregated form.
- Give honest feedback based on your own experience. Don't post fake, paid or misleading feedback, or feedback about places you haven't visited.
- Restaurants can't edit your feedback. We may remove feedback that breaks these Terms.
6. Product community
- Products you add become part of our shared product database, and may remain there (without your name) if you delete your account.
- Poll answers are combined with others' and may be shared with brands and shown publicly in aggregated form. We remove your personal identifiers before sharing with brands.
- Product information also comes from public sources such as USDA FoodData Central and Open Food Facts, and some descriptions are generated with AI. We don't guarantee it is complete or accurate.
- Brands may claim their brand pages after we verify ownership. Falsely claiming a brand is not allowed.
7. Acceptable use
You agree not to:
- Place fake or prank orders, or join a table you aren't sitting at.
- Abuse rewards or offers, for example by using multiple accounts, sharing codes to claim rewards you didn't earn, or manipulating visit counts.
- Post fake reviews or poll answers, or manipulate leaderboards, points or badges.
- Harass, threaten or abuse restaurant staff, other diners or other users.
- Upload content you don't have the rights to, or that is unlawful, defamatory, obscene or harmful.
- Access accounts, data or systems without permission, probe or bypass security, or interfere with the Platform's operation.
- Use bots, scrapers or automated means to access the Platform without our written permission.
- Use the Platform for anything illegal.
8. Content and intellectual property
- Your content (feedback, comments, photos, product contributions) stays yours. You give us a worldwide, non-exclusive, royalty-free license to host, display, adapt and share it to operate and promote the Platform, including sharing feedback with the restaurant or brand it's about. You confirm you have the rights to what you upload.
- Our Platform, including its software, design, names and logos, belongs to us and our licensors. These Terms don't give you any rights to them beyond using the Platform as intended.
- Restaurant and brand content (menus, photos, logos) belongs to the restaurant or brand.
- Suggestions you send us about the Platform may be used without any obligation to you.
9. Brand services and payments
- Brands may buy subscriptions for premium features and insights. Prices are shown before purchase.
- Subscriptions renew automatically until cancelled and can be cancelled at any time, effective at the end of the current billing period.
- Payments are processed by our payment provider (Stripe). Refund requests within 30 days of a charge are reviewed case by case.
- Free trials or pilot programs convert to paid subscriptions unless cancelled before the trial ends, if the offer says so.
- Restaurant subscriptions are covered by the Restaurant Terms.
10. Third-party services
The Platform works with services we don't control, such as Google sign-in and restaurants' point-of-sale systems (for example Clover). Their own terms and privacy policies apply to your use of them, and we aren't responsible for them.
11. Disclaimers
The Platform is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Platform will be uninterrupted or error-free, that menus, prices or product information are accurate, or that any restaurant will fulfill an order or honor a reward. Food, service and payment are the responsibility of the restaurant.
12. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Platform. Our total liability for any claim relating to the Platform is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) US $100. Some places don't allow these limits, so they may not apply to you.
13. Indemnity
You agree to defend and indemnify us against claims, losses and expenses (including reasonable legal fees) arising from your content, your misuse of the Platform, or your breach of these Terms.
14. Suspension and termination
- You can stop using the Platform at any time and ask us to delete your account by emailing privacy@hi1sagain.com or from your account settings where available.
- We may suspend or close accounts that break these Terms, involve fraud or abuse, or create risk for others. Unused rewards are lost when an account is closed for misuse. We may also close accounts inactive for 3 years after notice by email.
- To appeal a suspension, write to legal@hi1sagain.com.
- Sections that by their nature should continue (such as content licenses already granted, disclaimers, liability limits and dispute terms) survive termination.
15. Disputes and governing law
- Before starting a formal proceeding, contact legal@hi1sagain.com and give us 30 days to try to resolve the issue informally.
- These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where your local consumer law gives you the right to bring a claim where you live.
16. Changes to these Terms
We may update these Terms as the Platform changes. We'll post the new version here and, for material changes, notify account holders by email or on the Platform at least 30 days before they take effect. Continuing to use the Platform after that means you accept the changes; if you don't, stop using the Platform and you can ask us to delete your account.
17. General
- These Terms, the Privacy Policy and (for businesses) the Restaurant Terms are the entire agreement between you and us about the Platform.
- If any part is found unenforceable, the rest stays in effect. Not enforcing a provision doesn't waive it.
- We may assign these Terms as part of a merger, acquisition or sale of assets; you may not assign them without our consent.
- We aren't responsible for delays or failures caused by events beyond our reasonable control.
